This Privacy Notice configures the policy of OZZY FITNESS PTY LTD (“ Ozzy 24-hour  Fitness ”) ABN 93 661 150 and Intellectual Property. The Privacy Policy describes the  information that is collected, obtained, used and disclosed from or about you including  through our website www.ozzyfitness.com.au and applies to our Social Media sites, mobile phone applications and through any other for of communication with us not here mentioned  but does not apply to any social media platforms that are owned and operated by any other  individual, company or any other third party or organisation.

3 HOW OZZY FITNESS COLLECT YOUR PERSONAL INFORMATION OR  SENSITIVE INFORMATION  

For the purposes of this Privacy Policy:  

“ Personal Information ” is information, data or opinion about you from which your identity  is apparent or can be reasonably ascertained whether or not the information, data or opinion is  true and whether or not it is recorded in material form. Personal Information is collected as  your name, birth date, contact information, credit card details, bank details, height and  weight, a Form of identification such as driver’s license or passport and your image in a  photograph or video, and any other form of data collection not yet stated in this policy.  Personal Information is also collected when you provide business cards or other  documentation to us containing any form of personal information or identity when you  complete a membership agreement, direct debit form or agreement, questionnaires, or  medical and health questionnaire. Personal Information is also collected in the course of  providing services to you and communications between you and us. The type of personal  information may differ depending on whether you are (or would like to become) a franchisee,  customer, supplier, employee or independent contractor.  

Our prospective franchisees will also require company details including ABN/CAN, financial  status and information including bank account and credit card details, profit and loss  statements, balance sheets, sales information and data, and any other business related  information which may contain personal information.  

Our employees and prospective employees will collect various types of personal information  including employment dates of commencement or termination, employment status, contact  information, gender, date of birth, bank account details, emergency contact details,  qualifications, prior employment details, a form of ID including drivers license or passport,  superannuation information, tax file numbers, visa and immigration information and  information not yet stated in this Policy.  

“ Sensitive Information ” is personal information about an individuals health, racial or ethnic origin, political opinions, membership of a political association, religious beliefs or  affiliations, philosophical beliefs, membership of a professional or trade association or  membership of a trade union, sexual orientation or practices, criminal record, genetic  information, biometric information or templates and community status. Except for health  information, we do not generally seek to obtain sensitive information. Sensitive information  we will commit in accordance with the Privacy Act and this Policy. The types of sensitive  information generally collected includes information concerning your health and health  related information that is necessary to advise you about fitness and training properly.  

If you choose to provide us with unsolicited personal information or sensitive information,  you consent to our using of such information in accordance with this Privacy Policy.  

4 HOW OZZY FITNESS SHARES YOUR PERSONAL INFORMATION  

Ozzy Fitness may use and disclose your personal information to Third Party.  For example, we may use third-party vendors to conduct surveys or to help us with our  promotional efforts. These third-party vendors may need your personal information to  perform their obligations. Third party vendors are required to contract to keep your personal  information confidential and use it only to provide services on our behalf.  

+ Government bodies such as ATO, ASIC, Australian Prudential Regulatory Authority and  the police or courts (as required by law);  

+ various mobile phone applications such as MYOB Australia, Outlook email address (or  other form of E-mail), Banking service provider applications;  

+ various rewards partner program providers  

+ professional or government organisations, law enforcement agencies and governments for  security, customs and immigration purposes  

+ Third-Party Vendors: We may disclose your personal information to third-party vendors  who act on our behalf.

Ozzy Fitness continues to maintain professional administrative, physical and technological  procedures to protect the confidentiality and security of the personal information and  sensitive information that we collect, obtain and use. Unfortunately, no online server,  database or website is 100% (complete) secure or “ hacker and spam proof ”. Ozzy Fitness  and all associated with Ozzy Fitness therefore can not guarantee that your personal  information will not be disclosed, misused, tampered with, lost by accident or by the  unauthorised acts of any other individual or personnel. Moreso, we cannot control the misuse  of personal information or sensitive information you post in, on or through this site or social  media platform and any other social networking tools or applications that Ozzy Fitness is to provide or expect to provide and that you should have no expectation or satisfaction of  privacy in such information.
